Release of Liability

With the agreement to the release of liability you also agree and consent to the privacy policy.

As the client, and in consideration for my participation in breathwork, coaching and meditation sessions with Nikita Anand, Kundalini + Tantra Facilitator I agree that my participation in breathwork, meditation, coaching and overall calls is entirely voluntary and that I assume any risk associated with participation. Any actions or lack of actions, taken by me, the client, of such advice is done so solely by choice and responsibility, and any harm, injury or loss that may occur to me or my property as a result of my participation in the calls, is neither the responsibility nor liability of Anand - The Way Of Life or Nikita Anand.

I understand that breathwork, meditation, coaching and the overall calls are not a substitute for counseling, psychotherapy, psychoanalysis, mental health care or substance abuse treatment, and I will not use it in place of any form of therapy. I recognise that the calls require emotional, physical, and mental effort, exertion, and behavioural experimentation, on my part, which may cause physical, mental or emotional injury. I fully acknowledge and take full responsibility for all the risks involved. I understand that it is my responsibility to consult with my health care provider prior to participating in the calls.  In the event that I am injured, I agree to assume any financial obligation, either through my personal health insurance, or through some other means, for any medical costs I incur. Anand - The Way Of Life and Facilitator Nikita Anand assume no responsibility for any medical expenses, injury, or damage suffered by me in connection with the use of any facilities or services in connection with the calls.  IN CONSIDERATION OF MY PARTICIPATION IN THE PRACTICUM, I HEREBY GENERALLY RELEASE, AND PROMISE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS ANAND - THE WAY OF LIFE AND Facilitator, AND THEIR RESPECTIVE AGENTS AND EMPLOYEES (THE “RELEASE PARTIES”), FROM ANY LIABILITY WHATSOEVER. I will reimburse Anand - The Way Of Life and Facilitator for any damages, reasonable settlements and defense costs, including attorney’s fees, that they incur because of any such claims made against them. I agree that the terms of this agreement, including the indemnification obligations in this paragraph, will be binding on my estate, and my personal representative, executor, administrator or guardian will be obligated to respect and enforce them. This RELEASE does not extend to claims for gross negligence, intentional or reckless misconduct, or any other liabilities that applicable law does not permit to be excluded by agreement.  I agree that the purpose of this agreement is that it shall be an enforceable RELEASE OF LIABILITY AND INDEMNITY. I agree that if any portion or provision of this agreement is found to be invalid or unenforceable, then the remainder will continue in full force and effect. I also agree that any invalid provision will be modified or partially enforced to the maximum extent permitted by law to carry out the purpose of the agreement.  I understand that this is a contract that affects my legal rights, and I have read and understood this form and all its contents, and I voluntarily agree to the terms and conditions stated above.  To submit questions regarding this release please email: nikita@anandwayoflife.com

 

 

Client Service Agreement

Thank you for choosing Anand - The Way Of Life & Nikita Anand to advise and support you and your business! I am so incredibly excited to work with you! 

THIS AGREEMENT (the “Agreement”), is entered into on this date, by and between (Anand - The Way Of Life), “The Company” a Swiss sole proprietorship. For mailing address please email: nikita@anandwayoflife.com.

 


The Client and The Company agree as follows:

  1. Services

This is a coaching container facilitated by Anand - The Way Of Life to address specific personal growth areas, business issues, or general conditions in the client's life and profession. The intention of the program is to create a plan with the client on where they would like to take their life and business, with a strategy to get there and set target milestones along the way. Throughout the working relationship, Anand - The Way Of Life will engage in direct and personal conversations and teachings to support clients enrolled into this service. The client understands that to be successful there requires a co-active collaborative approach between client and the coach. In the coaching relationship, the coach plays the role of facilitating change, but it is the client's responsibility to enact or bring about the change. If the client believes they are not where they want to be or is not working as desired during the program, the client will communicate this with Anand - The Way Of Life as soon as possible and we will adjust the strategy to address the client’s desired outcome.

  1. Deliverables

  • [Number of coaching sessions selected upon checkout] in which there will be teaching and reactive coaching sessions with deep dive custom strategy sessions for life and business support; this may include breathwork, embodiment practices, mindset coaching, strategy support and any other practices to support the client.

  • Lifetime access to files, tools and documents that have been given to or created for client’s business needs

  • Exclusive mindset and personal growth homework developed specifically for client

  1. Communication

Anand - The Way Of Lifeg can be communicated with via What’sapp, Signal or Voxer. During the program, you will have access to the chosen App (What'sapp, Signal or Voxer) support from Monday to Friday unless otherwise communicated. Messages will receive a response within 48 hours. 

  1. Compensation and Payment.

The Services described in Section 1, The Client agrees to pay Anand - The Way Of Life as per checkout page description. The Client is responsible for the full payment amount of the contract term. There are no refunds. Payment will be made until complete. Anand - The Way Of Life holds the right to withdraw the client from services at any time if any payment is late or has not been received.

The client will receive session calls between 60-90 minutes. If a client cannot attend a coaching session, it is either to be rescheduled within 48 hours of the original call time or the session is forfeited.  

 

  1. Results

Anand - The Way Of Life will make reasonable and exceptional efforts to help the client with their business growth and mindset development. It is solely the responsibility of the client to take action on what they believe is the best strategy for getting to their desired outcome. Anything stated by any member of Anand - The Way Of Life is to be treated as an opinion and suggestion. It is at the discretion of the client to determine how to use the opinions discussed to dictate their future life and business strategy. 

 

  1. Refund and Cancellation Policy

The Client agrees that there is no refund policy. Once this service agreement is signed the payment agreement is to be fulfilled on the clients end and this service is requested at the client's choice. The client enters into coaching with full understanding that they are responsible for creating their own results. It is the responsibility of the user to make their own informed decision about the accuracy of the information discussed or provided throughout the coach and client relationship. In no event shall Anand - The Way Of Life refund the client during the duration of the agreement. The Company reserves the right to dispute such cancellation and pursue Client for monies owed to The Company for services agreed upon by the Client and Coach. If under the circumstance that you are unable to continue, there will be $1000 cancellation fee that will act as the final closing payment. Payment arrangements can be made for this final payment if needed. After the cancellation has taken place, all upcoming meetings will be cancelled. You will have access to the google drive folder with your customized work, but any shared documents and membership access will be terminated. 

  1. Media Waver and Portfolio Release.

Client agrees that The Company has the right to use materials created pursuant to this Agreement for The Company’s portfolio, samples, self-promotion including advertising for The Company’s business including without limitation Facebook or Instagram, or any other social media platform. In the event Client wishes to exclude some specific materials from the release under this paragraph, or to limit the time period of such release, The Company and Client may agree in writing to such limitation. The Client grants full permission to Anand - The Way Of Life and its agents and employees the irrevocable and unrestricted right to use the photographs and/or video images taken of you during the program, for the purpose of publication, promotion, illustration, advertising, or trade, in any manner or in any medium. The client releases Anand - The Way Of Life and its legal representatives for all claims and liability relating to said images or video. Furthermore, the client hereby releases, defends, indemnifies and holds harmless the producers from and against any claims, damages or liability arising from or related to the use of the images, recordings or materials, including but not limited to claims of defamation, invasion of privacy, or rights of publicity or copyright infringement, or any misuse, distortion, blurring, alteration, optical illusion or use in composite form that may occur or be produced in taking, processing, reduction or production of the finished product, its publication or distribution. 

The client waives any right to royalties or other compensation arising from or related to the use of the image. The client has read this document fully understands the contents, meaning and impact of this consent, waiver, indemnity and release.

  1. Release of Liability

Life Coaching is a service that provides support to specific individuals and/or groups to improve their life and coaching business. The client is aware that Life and Embodiment Coaching is in no way to be construed or substituted as psychological counselling or any other type of therapy or medical advice. The client understands and acknowledges the coach will not be liable legally or otherwise, for the actions the client may or may not under-take as a result of Life Coaching. No assumption of responsibility is made, or given, and the client requesting such services agrees not to hold individuals or Anand - The Way Of Life responsible or liable in any form or fashion, for such actions taken of their own accord. The method and process by which this advice and direction are given in no manner whatsoever, written or verbal, constitutes an agreement or liability on the part of the provider and is acknowledged to be different in many ways than clinical and medical counseling.

Client agrees that using any of these services are entirely at your own decisions. Any actions or lack of actions taken by the client of such advice is done solely by choice and responsibility of the client and is neither the responsibility nor liability of Anand - The Way Of Life. The client takes full responsibility in the decisions they make after being coached. The client enters into coaching with full understanding that they are responsible for creating their own results. It is the responsibility of the user to make their own informed decision about the accuracy of the information discussed or provided throughout the coach and client relationship. In no event shall Anand - The Way Of Life or any individual in the company be liable for any incident or consequential damages resulting from use of the material.

  1. Entire Agreement.

This Agreement is the final, complete and exclusive Agreement of the Parties. No modification of or amendment to this Agreement shall be effective unless in writing and signed by each of the Parties.
